什么是 NIW 国家利益豁免？
NIW（National Interest Waiver）是美国 EB-2 职业移民类别下的一个特殊通道，允许符合条件的申请人在无需雇主担保和劳工证的情况下自行申请绿卡。NIW 的法律依据为 INA § 203(b)(2)(B) 和 8 C.F.R. § 204.5(k)(4)(ii)。
2016年，AAO（行政上诉办公室）在 Matter of Dhanasar, 26 I&N Dec. 884 (AAO 2016) 案中确立了当前的三步测试框架，取代了此前沿用近20年的 Matter of NYSDOT 标准。申请人必须同时满足以下三个条件：
