What is EB-1A Extraordinary Ability?

EB-1A (Employment-Based First Preference, Extraordinary Ability) is the first preference category of US employment-based immigration, for foreign nationals with extraordinary ability in sciences, arts, education, business, or athletics. No employer sponsorship is required.

Under the two-step analysis established by Kazarian v. USCIS, 596 F.3d 1115 (9th Cir. 2010), USCIS reviews EB-1A petitions by: Step 1, objectively determining whether evidence meets at least 3 of the 10 criteria; Step 2, conducting a final merits determination of whether the totality of evidence demonstrates sustained national or international acclaim.

10 Criteria Overview (8 C.F.R. § 204.5(h)(3))

8. 8.领导或关键角色（Leading or Critical Role）— 在声誉卓越的组织或机构中担任领导或关键角色
9. 9.高薪酬（High Salary or Remuneration）— 相对于同领域其他人，获得高薪资或显著高报酬
10. 10.表演艺术商业成功（Commercial Success in Performing Arts）— 在表演艺术领域取得商业成功（票房、唱片销量等）
