2026 H-1B Lottery: Registration, Preparation & Critical Post-Selection Steps

The FY2026 H-1B electronic registration opens in early March 2026. Employers must complete registration and pay the $10 fee within the window. USCIS is expected to run the lottery in late March, with results announced in early April.

Key Registration Timeline

The registration window typically spans two to three weeks. Employers must submit electronic registrations for each beneficiary during this period. The "one beneficiary, one registration" policy implemented since 2024 has significantly reduced duplicate filings, improving selection rates. Each beneficiary can only be registered once by one employer — violations will void the registration.

The Critical 60-Day Filing Window

After selection, employers have 60 days to file the complete I-129 petition. Required documentation includes: Labor Condition Application (LCA), specialty occupation evidence, beneficiary's educational credentials and work experience, and proof of employer's ability to pay. We strongly recommend starting document preparation before the lottery.

Specialty Occupation Challenges

USCIS scrutiny of "specialty occupation" claims has intensified in recent years. Employers must thoroughly demonstrate that the position requires at minimum a bachelor's degree in a directly related field. Job descriptions should be specific and detailed, avoiding generic language that could trigger an RFE.

Wage Level Requirements

H-1B wages must meet or exceed the prevailing wage for the occupation and area. We recommend targeting Level 2 or above, as Level 1 wages face higher RFE rates. Employers should conduct thorough wage research before filing the LCA.
